Terms and Conditions 

By purchasing (sales, repair, customization, or classes) from Marinette Machine LLC you agree to these terms and conditions. 

Customer Responsibility 

It is the customer’s responsibility to know the of all the local laws and restrictions of the items or services purchased.  Check your local and state laws.  We are not responsible if you order an item not legal in your state, county, city/town, and other local laws/restrictions for you to possess.  If an item is not legal for you to own and/or possess, Marinette Machine LLC will not issue a refund. 

1. Verify the product you want to buy from Marinette Machine LLC meets your state, county, city/town, and other local laws/restrictions. 

1. Find a LOCAL Federal Firearms Licensee (FFL) near you that will accept your transfer if you are not picking up at our shop. 

1. Have your local FFL e-mail a file copy of their FFL to us at [email protected] 

1. Contact your local FFL about this transfer and find out the transfer if they will charge a fee to complete the transaction.   

1. You will need to pick up your order from your Local FFL once they receive the item. 

1. Your local FFL will be responsible for completing required background checks.

Before making a purchase a firearm or ammunition, you warrant that:  

1. YOU are not prohibited by Federal or State law, or local ordinance, from receiving firearms or ammunition, or ammunition components, of any kind. 

1. YOU are at least eighteen (18) years of age if purchasing long guns, long gun ammunition or ammunition components. 

1. YOU are at least twenty-one (21) years of age if purchasing a handgun or ATF-defined “OTHER” firearm (including, but not limited to, stripped receivers, frames, and pistol-grip shotguns) OR ammunition or ammunition components for use in handguns. 

1. YOU are the actual transferee/buyer of the firearm(s) you are purchasing from Marinette Machine LLC. (WARNING: You are not the actual buyer if you are acquiring the firearm(s) on behalf of another person). 

1. YOU are not under indictment or information in any court for a felony, or any other crime, for which the judge could imprison you for more than one year. 

1. YOU have not been convicted in any court of a felony, or any other crime, for which the judge could have imprisoned you for more than one year, even if you received a shorter sentence including probation. 

1. YOU are not a fugitive from justice. 

1. YOU are not an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance. 

1. YOU have not been adjudicated mentally defective (which includes a determination by a court, board, commission, or other lawful authority that you are a danger to yourself or to others or are incompetent to manage your own affairs) OR have not been committed to a mental institution. 

1. YOU have not been discharged from the Armed Forces under dishonorable conditions. 

1. YOU are not subject to a court order, including a military protection order issued by a military judge or magistrate, restraining you from harassing, stalking, or threatening your child or an intimate partner or child of such partner. 

1. YOU have not been convicted in any court of a misdemeanor crime of domestic violence. 

1. YOU have never renounced your United States citizenship. 

1. YOU are not an alien illegally in the United States. 

1. YOU are not currently on Federal NICS or State agency “DELAY” OR “DENIED” status regarding your most recent attempt to purchase a firearm. Firearm AND/OR ammunition or ammunition component sales or transfers are prohibited during these conditions. 

1. YOU understand that handling, cleaning, or discharging firearms, ammunition or ammunition components may cause exposure to lead, and YOU hold Marinette Machine LLC harmless, and YOU assume all responsibility for any lead exposure. 

Pricing 

Pricing is subject to change without notice.  Marinette Machine reserves the right to adjust price and offering due to changes in the market, product discontinuations, manufacturing price changes, errors in advertising and any other extenuating circumstances.  We make a reasonable effort to be accurate and keep information up to date we assume no liability or responsibility for any errors or omissions to content and pricing.   

Sales 

All used firearms are sold as is with no warranty.  All firearms sales are final. The sales agreement incorporates the entire agreement between you the customer and Marinette Machine LLC. The customer consents to receiving electronic records. 

Marinette Machine reserves the right to refuse sales to anyone without cause or reason. Marinette Machine will not discriminate based on any of the federally protected characteristics. Situations may include, but are not limited to, a feeling that the purchaser may be intending to commit a crime, do harm to his or herself or other persons, or is purchasing a firearm on behalf of any other individual (commonly known as a straw sale). Any behavior deemed suspicious by Marinette Machine shall be grounds for refusal of sale. 

Orders are not binding till accepted by Marinette Machine LLC.  Invoices are due and payable within 10 days from notification of project complete.  After 15 days from notification a certified letter will be sent to the provided address explaining the open balance and that the project is ready. Items remaining after 15 days from the written notification are subject to becoming property of Marinette Machine LLC and sold as inventory with the original purchaser forfeiting any deposits.   

There is a 3% CC transaction fee added to all orders when paying with CC/Debit card. 

Custom Orders 

All custom orders over $100 will require a minimum deposit of 50% of the total quoted price for project or the cost of all parts, whichever is higher. The remaining balance is due at pickup or prior to shipment.   

Gunsmithing 

Undisclosed or undiscovered damage or missing parts: We are not responsible for undisclosed or undiscovered damages of your firearm or missing parts as delivered. We will notify you upon discovery and give you the option of repairing these damages at your cost if repair is possible or replacing missing parts at your cost, if they are available. 

Cutting and drilling: While we are responsible for our workmanship, we are not responsible for cracking, chipping, splitting to the material or the material finish, either hidden or not, due to the quality of the material. Every effort is made to avoid these problems. We will try to repair damage that results from cutting or drilling of the defective material, at your expense, but do not guarantee that the results will be like new. 

Damage or loss of firearm caused by me or while in my possession: We will repair, replace, or reimburse at our discretion and at our expense. This does not include damage caused by shipping carriers. This does not include damage beyond our control. 

Older and used firearms generally have older, used parts that may fail overtime due to wear, use, lifespan etc. These circumstances are beyond MM’s control. Additionally, MM cannot be responsible for customer modifications or violations of the safety precautions and included disclaimers. Improper and careless handling of the firearm could result in negligent and/or accidental discharge and cause injury, death or damage to property. Modifications, corrosion, adjustment, or use of unspecified or damaged ammunition can also have these severe consequences. In these cases, the gunsmith (MM) shall not be held responsible in any manner whatsoever for the resulting consequences.  

Returns 

All returns must be postmarked or dropped off within 30 days of purchase date.  All items must be unused and in original packaging with labels attached.  After receiving the item, we will inspect the condition of your item and process the return. Please allow 7 days for us to process your return.

Liability 

It is the responsibility of the buyer/customer to ascertain and obey all applicable local, state, and federal laws regarding the possession and use of any item or service purchased from Marinette Machine LLC.  All sales (products and services) are under the condition that the seller shall not be liable in any action, arrest or injury during the transportation, handling, storage, sale or use of the product or service.   

Customer agrees to indemnify and hold harmless Marinette Machine LLC, its agents, independent contractors, servants or employees from all claims, losses, expenses, fees including attorney fees, costs, and judgments that may be asserted against Marinette Machine LLC that result from the acts or omissions of Customer, Customer’s employees, if any, and Customer’s agents.
